Welcome to pinkpn. The terms "we", "us" and "our" refer to pinkpn. pinkpn operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). pinkpn is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranties and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least 18 years old, or that you are using the Services with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

To use the Services, including browsing our store or purchasing any of our products, you may be asked to provide certain information, such as your name, email address, phone number, and billing and shipping details. You confirm that all information you provide is correct, current and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

SECTION 2 - OUR PRODUCTS
We have made every effort to show our products accurately. However, colours and product appearance may differ slightly from how they appear on your screen, depending on your device and its settings.

Product descriptions may change at any time without notice. We may discontinue any product at any time and may limit the quantities of any product we offer to any person or region, on a case-by-case basis.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. pinkpn may accept or decline your order at its discretion. Your order is accepted only once we confirm it and receive your payment. Please review your order carefully before submitting it, as each journal is prepared especially for your order and we may be unable to accommodate cancellation requests once an order is accepted. If we decline, change or cancel your order, we will contact you using the email address and/or phone number you provided, and any amount already paid for a cancelled order will be refunded to your original payment method.

Returns, replacements and refunds are handled in accordance with our Refund Policy.

You confirm that your purchases are for your own personal or household use and not for commercial resale.

SECTION 4 - PRICES, PAYMENT AND BILLING
All prices are listed in Indian Rupees (INR) and include applicable taxes. Delivery charges, if any, are shown at checkout before you pay, in accordance with our Shipping Policy. Prices, discounts and promotions may change without notice, but the price you pay is the price in effect when your order is placed, as set out in your order confirmation email.

We may offer promotions from time to time that are governed by separate terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will govern.

We accept the online payment methods shown at checkout. We do not currently offer cash on delivery.

You agree to provide current, complete and accurate payment and contact information for all purchases, and to keep your account details up to date so that we can complete your orders and contact you if needed. You confirm that you are authorised to use the payment method you provide.

SECTION 5 - SHIPPING AND DELIVERY
We currently ship within India only. Any delivery timelines shared are estimates and are not guaranteed. We are not responsible for delays caused by courier partners or events outside our reasonable control, but we will help you follow up on any delayed order. Please see our Shipping Policy for full details.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, designs, artwork, images, graphics, product reviews, video and audio, and the selection and arrangement of them, are owned by pinkpn, its affiliates or licensors and are protected by copyright, trademark and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any of the material on the Services, including our cover designs, without our prior written consent. Nothing in these Terms grants you a licence or other rights under any intellectual property of pinkpn, Shopify or any third party. All rights not expressly granted are reserved by pinkpn.

pinkpn's name, logos, product names, designs and slogans are trademarks of pinkpn or its affiliates or licensors. You must not use them without our prior written permission.

SECTION 7 - OPTIONAL TOOLS
You may be given access to tools offered by third parties as part of the Services, which we do not monitor or control. We provide access to such tools "as is" and "as available", without any warranties or endorsement, and we have no liability arising from your use of them. Your use of optional third-party tools is at your own risk, and you should make sure you are familiar with and approve of the terms on which they are provided.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to websites operated by third parties. We are not responsible for the content or accuracy of any third-party websites, and you access them at your own risk. Please review each third party's policies before you engage in any transaction with them.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
pinkpn is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with pinkpn. You acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and pinkpn, and you release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases from pinkpn.

SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is handled in accordance with our Privacy Policy.

SECTION 11 - FEEDBACK
If you submit any ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display that Feedback in any medium, including for commercial use. You confirm that you own or have the necessary rights to your Feedback and that it complies with these Terms.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, delivery charges or availability. We may correct any such errors and update information at any time. If an order is affected by a pricing or product error, we will contact you before processing it and, if you choose not to proceed, cancel the order and refund any amount paid.

You may use the Services for lawful purposes only. You may not use them to break any law, infringe intellectual property rights, harass or harm any person, transmit false or misleading information, or interfere with anyone else's use or enjoyment of the Services.

SECTION 14 - TERMINATION
We may suspend or end your access to the Services if you breach these Terms. You will remain responsible for any amounts due up to the date of termination.

SECTION 15 - WARRANTIES
We want you to love your journal. If your order arrives damaged, defective or incorrect, please contact us as set out in our Refund Policy and we will make it right. Apart from this and any rights you have under applicable law, the Services are provided "as is" and "as available", and we make no other warranties, express or implied.

SECTION 16 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, pinkpn and its partners, affiliates, contractors and service providers will not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of the Services or any product. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

SECTION 17 - INDEMNIFICATION
You agree to indemnify and hold harmless pinkpn, Shopify and our affiliates, partners, contractors and service providers from any losses, damages or claims arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your misuse of the Services.

SECTION 18 - YOUR RIGHTS AS A CONSUMER
Nothing in these Terms limits or excludes any rights you have under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, or any other applicable law that cannot be limited or excluded by agreement.

These Terms are governed by the laws of India. Subject to Section 18, you and pinkpn agree that the courts of Hyderabad, Telangana, India have jurisdiction over any dispute arising from these Terms.

SECTION 21 - CHANGES TO THESE TERMS
We may update, change or replace any part of these Terms at any time by posting the updated version on this page. Changes will not affect orders placed before the update. Your continued use of the Services after changes are posted means you accept them.
